Important Disclaimers

1. Acceptance of Terms

By accessing and using Teleport2Play ("the Service"), you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Service.

Your use of Teleport2Play is also subject to Second Life's Terms of Service and Terms and Conditions.

2. Service Description

Teleport2Play is a web-based platform that provides information about gaming locations within the Second Life virtual world. Our Service includes:

• Real-time tracking of game locations ("balloons") in Second Life
• Player count and activity information
• Instant teleportation links (SLURLs) to game locations
• Leaderboards and statistics
• User account management for game owners

3. Compliance with Second Life Policies

3.1 No Skill Gaming

Teleport2Play does NOT operate, facilitate, or promote Skill Gaming as defined by Linden Lab. All games featured on our platform:

• Do NOT require Linden Dollar (L$) payments to play with L$ payouts based on skill
• Do NOT operate in licensed Skill Gaming regions
• Do NOT meet the four-part test for Skill Gaming (skill-based outcome, L$ payment required, L$ payouts, legal compliance certification)
• Are NOT subject to Skill Gaming licensing fees or requirements

3.2 No Gambling or Games of Chance

In compliance with Second Life's Terms of Service, Teleport2Play does NOT:

• Operate or promote gambling or games of chance
• Facilitate wagering with Linden Dollars on random outcomes
• Run virtual banking operations
• Operate slot machines, poker games, or similar gambling activities

3.3 Virtual Currency Compliance

We acknowledge that Linden Dollars (L$):

• Are NOT currency or any type of currency substitute
• Are NOT redeemable for money from Linden Lab
• Can only be traded through the official LindeX exchange
• Represent limited licenses, not property or stored value

Teleport2Play does NOT facilitate L$ transactions outside of Linden Lab's official systems.

3.4 Age Restrictions

Users must comply with Second Life's age requirements. Any activities involving virtual currency or adult content require users to be at least 18 years old (or 19+ for certain jurisdictions).

4. User Responsibilities

By using Teleport2Play, you agree to:

• Comply with all Second Life Terms of Service and Community Standards
• Provide accurate Second Life avatar information during registration
• Not use the Service for any illegal or unauthorized purpose
• Not violate any laws in your jurisdiction (including but not limited to gambling laws)
• Not attempt to manipulate leaderboards or player counts
• Not use automated bots or scripts to interact with the Service
• Maintain your account security and confidentiality

5. Game Owner Responsibilities

If you register as a game owner on Teleport2Play, you additionally agree to:

• Own or have permission to operate the game locations you list
• Ensure your games comply with all Second Life policies and local laws
• NOT operate Skill Gaming without proper Linden Lab licensing
• NOT operate gambling or games of chance in violation of Second Life TOS
• Provide accurate information about game locations, prizes, and rules
• Respond to player complaints and maintain fair gaming practices
• Keep your game information up-to-date on the platform

6. Intellectual Property

Teleport2Play respects intellectual property rights. All trademarks, logos, and service marks displayed on this Service are the property of their respective owners.

Second Life®, Linden Lab®, and the Linden Lab logo are registered trademarks of Linden Research, Inc. Teleport2Play is not affiliated with Linden Lab and does not claim any ownership of these marks.

The Teleport2Play name, logo, and original content are the property of Teleport2Play and may not be used without permission.

7. Limitation of Liability

7.1 Service Provided "AS IS"

Teleport2Play is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement of intellectual property
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free service

7.2 No Responsibility For

We are NOT responsible for:

• The operation, content, policies, or availability of Second Life or Linden Lab services
• Actions, conduct, or content of game owners, players, or third parties within Second Life
• Loss, theft, or transfer of Linden Dollars (L$) or virtual items
• Disputes between users and game owners, or between users
• Service interruptions, downtime, data loss, or inaccurate information
• Actions taken by Linden Lab against your Second Life account (bans, suspensions, warnings)
• Technical failures, server outages, or connectivity issues
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Service
• Economic losses from participation in games or activities

7.3 Aggregate Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total aggregate liability to you for any and all claims arising from or related to the Service shall be limited to the GREATER of:

• €100 (one hundred euros), OR
• The amount you paid to us (if any) in the 12 months preceding the claim

7.4 Exclusion of Consequential Damages

IN NO EVENT SHALL TELEPORT2PLAY BE LIABLE FOR ANY:

• Indirect, incidental, special, exemplary, or consequential damages
• Loss of profits, revenue, data, or goodwill
• Business interruption or loss of business opportunities
• Loss of virtual currency, items, or in-game assets
• Emotional distress or reputational harm
• Cost of procuring substitute goods or services

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

7.5 Mandatory Legal Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Willful or grossly negligent behavior
• Any other liability that cannot be excluded or limited under applicable law

7.6 Linden Dollar Disclaimer

You acknowledge and agree that:

• Linden Dollars (L$) have NO real-world monetary value
• L$ are virtual licenses, NOT currency, property, or stored value
• L$ are NOT redeemable for money from Linden Lab or Teleport2Play
• You have NO ownership rights to L$ obtained through our Service
• We have NO control over L$ transactions, balances, or transfers
• Linden Lab may revoke, freeze, or confiscate L$ at any time without notice
• Any L$ prizes or rewards are subject to Second Life Terms of Service

8. Indemnification

You agree to indemnify, defend, and hold harmless Teleport2Play, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of Second Life Terms of Service or Community Standards
• Your violation of any rights of another person or entity
• Your conduct within Second Life, including any games or activities
• Any content you submit, post, or transmit through the Service
• Any dispute between you and other users or game owners
• Any loss of Linden Dollars or virtual items
• Your breach of any representation or warranty in these Terms

This indemnification obligation will survive termination of your account and these Terms of Service.

9. Privacy and Data Protection

We are committed to protecting your privacy and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR).

What We Collect:

• Email address (optional for notifications)
• Second Life avatar name, UUID, and in-world information
• Game statistics, preferences, and activity history
• IP address, browser type, and usage data
• Cookie consent preferences

What We Do NOT Do:

• Sell your data to third parties
• Access your Second Life account credentials
• Share your personal information without your consent (except as legally required)

10. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Violation of Second Life Terms of Service or Community Standards
• Fraudulent, abusive, or illegal activity
• Manipulation of leaderboards, games, or statistics
• Use of bots, automation, or unauthorized scripts
• Harassment, threats, or inappropriate conduct
• Any conduct we deem harmful to the Service, other users, or our reputation

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at cecil.gudkov@teleport2play.com to attempt to resolve the issue informally. We will make good-faith efforts to resolve disputes amicably within 30 days.

11.2 No Class Actions

YOU AND TELEPORT2PLAY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

Unless both you and Teleport2Play agree otherwise, no arbitrator or judge may consolidate more than one person's claims or preside over any form of representative or class proceeding.

11.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts located in Romania.

12. Changes to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email (if you have provided an email address)
• Display a prominent notice on our website

Your continued use of the Service after any changes constitutes acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the Service immediately.

It is your responsibility to review these Terms periodically for changes. We recommend checking this page every 30 days.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Teleport2Play regarding the use of the Service, and supersede any prior agreements, understandings, or representations.

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
